U.S. judge says illegal immigrant allowed to marry

PHILADELPHIA – A Pennsylvania official cannot require an illegal immigrant to prove his lawful presence in the United States to get a license to marry his girlfriend, a federal judge ruled on Tuesday.

Judge A. Richard Caputo of the Middle District of Pennsylvania granted a preliminary injunction barring Dorothy Stankovic, register of wills for Luzerne County, from making Jose Guadelupe Arias-Maravilla produce proof of legal residence as a condition for obtaining a marriage license.

It is the first legal test of whether a local authority can make immigration status a condition of getting a marriage license, said Mary Catherine Roper of the American Civil Liberties Union, or ACLU, which represented Arias-Maravilla, who is from Mexico, and his girlfriend Heather Buck, a U.S. citizen.
